Flanagan sentenced to 18 years

Wilford George Flanagan, Jr., pled guilty November 28th to Intoxication Assault with a Deadly Weapon and Driving While Intoxicated (third offense) in the 402nd Judicial District Court of Wood County.

This past summer, Wood County District Attorney Jim Wheeler presented two third-degree felony cases involving the defendant. Each could carry punishment of up to ten years in the penitentiary.

Those indictments involved allegations that on January 19th, 2007, Flanagan had driven his tractor trailer through the front of three businesses adjacent to the courthouse in Quitman, striking and seriously injuring a pedestrian, destroying a vehicle and causing significant property damage.

Flanagan’s victim was transported by helicopter to Tyler for emergency medical care and the case was prepared for prosecution by the Quitman police and the Texas Department of Public Safety.

Laboratory results obtained at the request of Texas State Trooper Larry Vaughn indicated that Flanagan’s blood alcohol concentration was more than three times the legal limit in Texas at the time of the incident.
Judge Timothy Boswell sentenced Flanagan to 10 years incarceration for the charge of intoxication assault, plus a $2,000 fine, restitution and costs of court.

The judge also sentenced Flanagan to eight years incarceration and costs of court for the charge of driving while intoxicated. With the deadly weapon finding, Flanagan must serve one-half of his sentence day-for-day before he becomes eligible for parole. The sentences will run concurrently.
